Exit primacy national legislation. IP-rights that can be enforced in an EU Member State are no longer only IP-rights that are established under national law. IP-rights that are enforceable in a Member State also find their basis in several EU regulations. Furthermore, the requirements for – and scope of – national IP-rights is also to a large extent determined by EU directives and international treaties. The intangible nature of the subject matter protected by IP-rights and the fact that the exploitation possibilities do not stop at national borders, has led to the present situation in which IP law has to a very large extent become (European) supranational law.
