Article 67b - Interruption of proceedings
Print this page1. Proceedings before the Office shall be interrupted:
(a) in the event of the death or legal incapacity of the applicant for, or holder of, a registered EU design or of the person authorised by national law to act on behalf of the applicant or holder.
(b) in the event of the applicant for, or holder of, a registered EU design being prevented, for legal reasons resulting from action taken against the applicant’s or holder’s property, from continuing the proceedings before the Office;
(c) in the event of the death or legal incapacity of the representative of an applicant for, or holder of, a registered EU design, or of that representative being prevented, for legal reasons resulting from action taken against the representative’s property, from continuing the proceedings before the Office. To the extent that the death or incapacity referred to in the first subparagraph, point (a), does not affect the authorisation of a representative appointed under Article 78, proceedings shall be interrupted only on request by such representative.
2. Proceedings before the Office may be resumed as soon as the identity of the person authorised to continue them has been established or the Office has exhausted all reasonable attempts to establish the identity of such person.
