Request for simultaneous interpretation from French to English and vice versa denied. Hearing to be held in English. (Rule 109.2 RoP)
Procedural rules must be applied in a flexible and balanced manner, with the requisite degree of discretion.
An official representative of the Respondents not having command of the language of the proceedings does not constitute sufficient justification.
Simultaneous interpretation would offer no advantage over conducting the hearing in English as the Court, parties and representatives have a good command of both French and English
