UPC CoA, 18 September 2024: Change of language because of internal working language of the parties

On grounds of fairness to defendant Apple the language of the proceedings is changed from German to English, the language in which the patent was granted (Article 49(5) UPCA).
In addition to the circumstances stated by the Court of Appeal in its order of 17 April 2024 [Curio Bioscience v 10x Genomics] the internal working language of the parties, the possibility of internal coordination and of support on technical issues are relevant circumstances.
